2.3. Avatar is the “Tolky”, which represents the virtual assistant being used.

2.4. Manager is the person or entity who acquires the platform for private operation.

2.5. Public represents anyone who utilizes the platform without undergoing registration.

3.1. To utilize the technology, you must be at least 18 years old. If you are under the permitted age, legal guardian permission is required.

3.2. In this case, these terms will apply to the guardian who allows the child to use the services.

4.1. To maintain a respectful environment for all users, you must follow these guidelines:

a) Comply with applicable laws;

b) Respect other people's rights, including privacy and intellectual property;

c) Do not abuse or harm others, threaten or encourage such conduct, such as deceiving, defrauding, falsifying identity, defaming, slandering, libeling, bullying, harassing, or stalking;

d) Do not abuse, harm, interrupt, or interfere with the services, such as attempting to access or use them fraudulently, introducing malware, hacking, spamming, or similar actions.

5.1. To use the Avatar, access the website.

5.2. The general public may use the platform without providing personal data or logging in.

5.3. For a customized experience, complete registration with photo, name, phone number, and email.

5.4. When registration is required or optional, create a personal password after completion. By logging in, you access the manager dedicated area and maintain a digital profile.

5.5. Only one registration is allowed per user. Access, viewing, and usage are personal and non-transferable.

5.6. You are responsible for safeguarding and maintaining the confidentiality of your password. Unauthorized access by third parties is your responsibility.

5.7. To discontinue or cancel services, send an email to contato@tolky.to.

5.8. If the service is used inappropriately, violating these terms, the company may block or cancel access without prior notice.

6.1. The data you provide is accessed exclusively by the Manager. Tolky uses this data solely to customize your experience during use and does not share it with third parties.

6.2. The Avatar utilizes company technology and is customized based on the provided data. Responses and interactions are automatic and generated by algorithms.

6.3. You assume full responsibility for the Avatar's responses and interactions, freeing the company from any of its declarations, actions, or omissions.

6.4. The company is not liable for damages caused by third parties or force majeure events.

6.5. Permission to use the services does not grant any intellectual property rights over them.

6.6. The Avatar technology is company property. Content created on the platform is the property of the Manager. The Manager's database is used exclusively in the Avatar's operations and does not communicate with other systems.

7.1. These terms are effective upon acceptance and utilization of the services and terminate upon their cessation, without the need for prior notice.
